"Out of thin air" should be a favorite movie of our judicial system. For a long time, China's unjust, false and wrongful convictions have been criticized for a long time. In fact, Europe and the United States are not much better, and a large number of "recognized murderers" have been acquitted. Wrongful killing and misplacement are originally a pair of irreconcilable contradictions, and one will inevitably lose the other. There is no formal distinction between the two, nor is the law itself good or bad. It is only the different manifestations of criminal policy, and criminal policy depends on the comprehensive factors of a country's history, culture, national character and civic quality.
So, why is the judicial authority of our country so much worse than that of Europe and the United States? There may be many reasons, but I think the first is related to the fact that our judicial system itself does not correctly understand and publicize the status and role of the judiciary. Don’t forget the importance of the rule of law, but forget that the judiciary is only a small part of the rule of law; always say that the law is the last line of defense to protect rights, but in fact there is another behind it (everyone knows what it is); always say that the judiciary should serve the people, However, it ignores the negative objective attribute of judicial neutrality. If you can't recognize yourself, how can you blame others for not seeing you properly?
