An important principle of modern criminal law is that "laws are not retroactive". That is to say, if an act was not considered guilty before, and after the act occurred, the law stipulates that the act is an illegal act, then the newly established law cannot punish the previous act. The purpose of the principle of non-retroactivity of law is to maintain the predictability of the law for ordinary citizens. As long as the law does not prohibit it, they can do it with confidence, without worrying that this behavior will suddenly be considered a crime one day. This is also the difference between criminal law and morality. Morality is that an act that violates one’s inner conscience and still does it can be condemned; while criminal law is that as long as an act does not violate a certain law, even if you know that it may be wrong, you should not be punished.
The defendant's actions violated the common principles of civilized society. The state is not a stone, but an extension of man—justice, truth, personal values, are the basic values of the state.
The so-called fairness and justice may just be because we are on the side that will not be reviled by morality.
