A fledgling elementary law student's thoughts on euthanasia

Euthanasia is an old topic not only for medical students, but also for law students. In the past few years, the impression of this movie has only left the doctor's insistence on the freedom of people to choose death and the loneliness of fighting against the world but being sentenced. When putting on the plastic bag to release the euthanasia gas, he struggled frantically to tear off the bag. Maybe even a person who was desperate enough to die would still instinctively survive the moment he faced death. A month or two ago, when I was discussing freedom in a law class, I thought of euthanasia again.

The first fact is that Chinese law does not stipulate whether euthanasia is legal or not. The second is the case: ① The first case of euthanasia in China was in 1986. Xiao Wang's mother was seriously ill and cried out that she wanted to die. Xiao Wang thought it would be better to help his mother to get rid of it. He repeatedly asked the doctor to euthanize his mother. When prosecuting Xiao Wang, the court considered moral rationality on the grounds that the crime was minor, and ruled that it was illegal but exempted from criminal punishment; after several appeals and academic discussions, Xiao Wang and his sister were finally acquitted by the Supreme Court. ②In 2001, Xiaoliang was convicted of intentional homicide after performing electrocution "euthanasia" for his 92-year-old mother who was in a deep coma and paralyzed by cerebral hemorrhage. (without the consent of the person being euthanized)

A little opinion: (1) Does euthanasia need to be included in the scope of legal adjustment? I feel the need.

① Euthanasia is a type of suicide. It is the demise of an individual. It seems to have only personal meaning on the surface, but it also has direct or indirect effects on others, such as property division. [This is the acquiescence of euthanasia’s immediate will to implement euthanasia, and in other cases, the person who assists euthanasia guides the implementation of euthanasia] For example, children are euthanized to their parents in order to obtain an inheritance; forgery of euthanasia means committing homicide, etc., euthanasia in these cases The influence on others outside the personal meaning is more obvious. ②Because there are many difficulties in the legal determination of euthanasia, such as the determination of the critical point of autonomy (than when Xiao Wang's mother shouted "I'm going to die", she was eager to see the king immediately, but when euthanasia was implemented, she felt that she was reluctant to bear Xiao Wang, and she was reluctant to bear Xiao Wang. Sister, I am reluctant to live in this beautiful world for another five hundred years, but I have no choice but to die. I suddenly regretted at the moment of death, euthanasia goes against the original intention of voluntary, and the independent behavior has lost its foundation. There are problems of medical cure and notarization, so I can understand that today's law adopts an evasive attitude towards this issue. However, with the improvement of human rights, the accumulation of euthanasia cases, and our generation's yearning for euthanasia, this issue will gradually become an unavoidable issue.

(2) Do you recognize euthanasia? I do.

①Although euthanasia involves ethics and morals such as the supremacy of life and the possibility of ineffective treatment, the recognition of euthanasia is also a release and affirmation of human autonomy and human dignity. ②Simply put, it is so rude and true that it is better to die happily than to live in pain. Voluntary euthanasia vs murder euthanasia should be resolved with the improvement of norms, but when will the legal threshold and moral consideration threshold for allowing euthanasia be crossed, there is a long way to go. Only by studying hard can we earn money and go to Switzerland to seek death in happiness and peace.

You Don't Know Jack quotes

  • Jack Kevorkian: It's emotionalism. You know, when heart transplants first started... there was the same prevalent feeling, I mean, even among doctors... that it was wrong, it was contrary to God's will, contrary to nature. Isn't it ghoulish to rip a person's chest open and take out a heart? Or a bypass operation? Ether is the same thing. You have ether, been around for centuries, it wasn't used. Not till 1846. It was discovered in 1543... and before that, everybody was being operated on while they were awake. Surgeons were cutting them open while they were awake. Did you know that, Geoff?

    Geoffery Fieger: No.

Jack Kevorkian: On, yes. And you know why it was banned? Because of religious dogma. Because of the foolish notion... that there's a God Almighty who wills us to suffer.

Judge Cooper: I assume the debate will continue in a calm and reasoned forum long after this trial and your activities have faded from the public memory.

Judge Cooper: But this trial was not about that controversy.

Judge Cooper: This trial was about you, sir.

Judge Cooper: You've ignored and challenged the legislature and the supreme court.

Judge Cooper: Moreover, you've defied your own medical profession.
