On September 18, 2019, the news from the other end of the Yellow Sea ranked among the domestic hot searches. One of the three outstanding cases in South Korea, the "Hwaseong Serial Murder", has made new progress. The reason why this case was well-known all over the world across the ocean is the 2003 movie "Memories of Murder", which shows a series of rapes that occurred in Taean-eup, Hwaseong-gun, Gyeonggi-do, South Korea between 1986 and 1991. Murder. Since its premiere, it has been released in more than 30 countries around the world and Hong Kong, China. Countless people have started to pay attention to this case. At the same time, because of the unresolved ending, many people feel depressed for a period of time. But today, after 33 years of long-distance running, the case will finally have a result.
The South Korean police used DNA personal identification technology to identify the true culprit of the "Hwaseong serial homicide"-the 56-year-old criminal "Li Chuncai" now detained in the Busan Prison in a recent comparative inspection. With the in-depth investigation after the "Hwaseong serial murder case" was restarted, more victims and details were unearthed. From the well-known 10-person serial murder tragedy, it evolved into a terrifying incident involving 15 murders and more than 30 rapes. .
The latest development of the incident as of press time:
①Other transliterated names: Li Chunzai, Li Chuncai, Li Chunzai, Li Chunzai
Warning: The following involves some spoilers
In the early autumn of 1986, a 72-year-old woman, Li Wanren, took home vegetables and sold them near the bus station in Suwon City as usual. After that, she visited her daughter living in Taean-eup and stayed overnight. In the early morning of the next day, the sky was not clear, and she was anxious to work in farming. She refused her daughter's stay and set foot on the country road back home. Unexpectedly, the rickety figure that disappeared in the morning mist became the last farewell of the mother and daughter.
Five days later, when local villagers were harvesting pastures, they found Li Wanren's body, which was only ten minutes away from his daughter's home. No obvious signs of sexual assault were found during the investigation, but the victim's pants have been taken off, and no physical evidence of the suspect was found except for the remains of the deceased. Later, the South Korean National Institute of Scientific Research (hereinafter referred to as "Guokesou") identified the cause of death by constriction, and no semen could be found in the specimens and remains collected at the scene. It is assumed that the deceased did not Being sexually assaulted.
At the beginning of the investigation, the police did not pay much attention to the case, and failed to foresee a serial homicide that spanned more than 30 years from then on...
Over the past 30 years, with the overall economic growth of South Korea, high-rise buildings were already taking place at that time. The cruel facts are also forgotten by most people, but everyone who has experienced it is painful. Some of the victims' survivors are deceased and some have left their hometowns; some criminal police investigating cases have left their posts and some are paralyzed in bed. The suspects under investigation, some died tragically, and some were wronged and imprisoned. The accumulation of depression in the hearts of the parties is like the lingering haze in the film, and this kind of pain may continue even today...
If you want to understand the story of the Hwaseong serial homicide case, you first need to understand the background of the place where the incident occurred. Although the location of the incident has changed through the times, many specific addresses cannot be verified, but after consulting relevant materials, it can be determined that the cases are concentrated in today's Gyeonggi Province. Around Hwaseong East Bakery Station.
The Taean-eup area where the case occurred was far behind other surrounding towns at the time. However, because the industrial road runs through the east and west, many vehicles have been passing through. Suwon is in the east, Hwaseong and Osan are in the west, and Sihwa Industrial Complex and Banwol in the southwest. In the industrial park, there are some villages in the north, except for rice fields and wild mountains, and a few sporadic factories are located in it.
In the 1970s, the crime scene was a typical rural area. However, with the economic growth in the 1980s, the number of nearby factories increased and the influx of a large number of people was driven, which indirectly led to the high incidence of rape incidents in the region. Statistics show that there are more than 20 occurrences every year, which once became a serious problem in the process of rural urbanization at that time.
One month after Li Wanren was killed, the second case occurred. A local farmer found a naked female body in the concrete waterway that provided water to the cultivated land, with multiple puncture wounds on the chest and back.
After investigation, the deceased was Park Hyun-sook, a beautiful girl who lived alone in Xinjing-dong, Songtan City. On the day of the murder, her adoptive mother Xu Youngsun (45 years old) asked her to go home and told her to introduce her a very good boyfriend. For this reason, Park Hyun-sook was very beautifully dressed. She changed into a new shirt and skirt and put on light makeup. , And the process seemed to go smoothly. It continued until the end of the night when Xu Yingshun sent her adopted daughter to the village entrance as usual. After that, Park Hyun-sook, who went home alone, disappeared on the road and was not found until 3 days later.
The police collected semen, cigarette butts, hair and other physical evidence during the site investigation. Although the hemorrhagic type cannot be detected ① due to contamination of semen, two blood types of O and B are obtained from the hair at the scene. After comparing and excluding the blood type of the victim, it can be determined that the other person at the scene has type B blood, but it is impossible to determine whether it is left by the suspect. .
Some villagers sighed, “People are coming and going up and down, but there is a corpse lying underneath.”
The real prototype starring in the movie, Seung-kyun Ha, was added to the reconnaissance work after this case in reality. However, there has been no progress in the investigation. In early 1988, a suspect died after the investigation, and three criminal police officers in charge of the investigation were arrested, including his subordinates. He was also suspended for three months for this reason. In the fall of the same year, another subordinate suffered a cerebral hemorrhage during the investigation and is still paralyzed in bed today.
①In the late 1980s, Professor Alec Jeffreys (Sir) of the University of Leicester discovered that DNA can be used for personal identification and tried to help the British police finally identify the uniqueness of criminals. Forensic research such as genetic identification and hair collection Work just started to rise. In fact, South Korea at that time did not have such an investigation system in case detection, so even if it had a large amount of evidence, the perpetrators continued to commit crimes with impunity.
The third victim was a female worker in a pastry factory, Quan Zhengfun. She took the bus to Suwon to visit her husband Kim Jong-min (27 years old) as soon as she got married. The two who were in the honeymoon period forgot about the time. We separated from each other late at night. Because her husband needed the right to work, Wen had to go home alone, so there was no more news.
More than 4 months later, Jin Jiyuan (a pseudonym 29), who was working on the repair of the ridge, found a highly corrupt body in the pile of sandbags. The deceased’s pants were taken off, and his mouth was stuffed with stockings and stained with blood. The underwear was worn on the head. After the police arrived at the scene, the information on the source of the body was quickly ascertained through a wooden seal. It was Quan Zhengfen, who had been missing for 130 days. The body was so corrupt that it was difficult to conduct an autopsy. No evidence of the criminal was found at the scene. Although part of the hair was recovered, it belonged to the victim after being searched and identified by the National Science and Technology Bureau. No clear evidence was found in other materials collected.
The fourth victim, Li Guisook, went directly to the coffee shop in Suwon City after work from the Water Purification Fiber Company for a blind date. Because it was a well-known beauty nearby, the other party was very satisfied and talked about the separation of the two talents late at night. Li Guishu, who was on the last train alone in the dark rainy night, was witnessed disappearing into a deep village road in the official project.
A week later, Li Guishu was found in the field next to Guanxiang River. The body was buried in a bale of Suzi, his hands were tied behind his back with a chiffon shirt, and he was wearing a red coat. The umbrella handle left at the scene was stained with blood. , After checking, the blood stains came from the victim's lower body. Semen was detected in the material evidence handkerchief, but due to the rain on the day of the incident and prolonged exposure to the surrounding environment, the blood type could not be accurately determined. Although the blood type was finally determined to be type B blood, Li Guishu was also type B blood. At this time, the police had not noticed that the body of the human rights victim in the third case was lying not far away.
① In a factory in Anningli, Taian-eup, the victim of Case 3, where he passed on the day he was killed
Less than a month after Li Guishu was killed, another murder occurred. Hong Jinying, an 18-year-old female high school student, is about to graduate. From a poor family, she delivered her resume to a company in Suwon City on the morning of the 10th. Afterwards, she met with friends at North Gate. Because it was a holiday, she stayed for a long time and didn’t talk to her until after dinner. The friend bid farewell, got on the bus returning home, and was killed shortly after getting off the bus.
The body of Hong Jinying was found in a straw bale the next day. His hands were tied behind a bra, his mouth was stuffed with socks, and a scarf was wrapped around his neck. Hair, pubic hair, rags, etc. were found at the scene. It was found by comparing the pubic hair and the inspection materials on the cloth. Both belong to type B blood.
Three months later, the body of the third victim of Human Rights Zhengfan was found. The outflow of news made the residents of Tai'an County panic and put everyone at risk. Five consecutive women were raped and killed by the same method, and the police began to pay more attention to the case. In order to resolve the case as soon as possible, the police expanded their police force and replaced the former Hwaseong Police Commissioner who appointed the then Gyeonggi Regional Police Department Chief (Police Officer). Secretary) to investigate. According to the memories of local residents, "there were more police than people"
In the sixth case, it rained heavily that night. It didn’t stop for a long time. The housewife Park Eun-joo was worried that she would return to her husband without an umbrella. The bigger the bottom...
Park Eun-joo's husband took a bus from Suwon at 22:30 in the evening, got off at around 23:00, and ran home in the rain, but his wife was not seen.
A week later, a group of children returning from school found Pu’s body beside the grave on Mount Tai’an. The site investigation revealed that the body was naked, with hands tied behind his back, and a chiffon shirt and bra hung around his neck. Two umbrellas were scattered around the scene. There are women's tops and panties, and there are 255mm shoe prints. In the subsequent appraisal, semen was found in the coat, and the blood type A was identified, which was the same as the blood type of her husband, and the murderer could not be determined.
A series of rapes and murders finally broke out after Park Eun-joo was killed. The media focused on criticizing the police for their incompetence in handling the case, and the case caused a national sensation for a while. The public thought that this intimidated the criminals, and then remained silent for a long time without adding new cases. Until the eve of the Seoul Olympics in 1988, panic spread again.
It is worth noting that according to Li Chuncai's self-report of the case, the Hwaseong police investigated him in this case, and the so-called suspension of the crime did not last long.
At the end of the year, the police's nerves were tense again. On Christmas Eve, there was a murder case in Huaxi Cave. The 18-year-old high school girl Jin Hyun-sook ran away from home because of a quarrel with his mother. Ten days later, he was found in a field near Huaxi Station. The body was hidden in straw, his hands were tied back, his pants were taken off, and his mouth was stuffed with underwear. The modus operandi was very similar to that of the "Hwaseong Serial Murders". Soon the police arrested a 17-year-old boy (Ming), who was tortured to death by the police. This incident caused a great social response and three criminal police officers were arrested and sentenced.
The 1980s was a dark period in South Korea's modern history. The dictatorship led by Jeon Doo-hwan continued to arrest and persecute human rights organizations and dissidents, and brutally suppressed and massacred demonstrations. The police are often temporarily called into violent suppression operations, so that the grassroots police force has been insufficient for a long time, causing many cases to miss the best detection period. The police, who have been soaked in gunpowder and blood for a long time, abused their power at will, making torture and interrogation the main method of handling cases. There are even some policemen who are obsessed with torture and sneer at physical evidence and complicated scientific investigation methods, only believing that their fists and instruments of torture can bring the truth.
The most representative one is the former police officer, Li Gen'an. He is famous for his method of extorting confessions with severe torture. He has created many dauntingly cruel punishments. Water torture, electric torture, and beatings are commonplace. When he is cruel, he will even hit the victim. A ballpoint pen was inserted into his urethra. People at the time were trembling with fear when he heard his name. There were countless people suffering from disability and traumatic sequelae due to his torture. Among them were young students who were under pressure and ended their lives. What is unbelievable is that Li Gen'an was not only not accountable at the time, but was even commended and promoted for his torture technique. This "honor" has also become the target of some grassroots police. The side reaction reflects why there were so many Li Gen'an in the police force at that time.
A vicious case occurred on the eve of the Seoul Olympics in 1988. An Gisun’s eldest son ran a snack bar in Suwon City, where she usually helped. After the work of the day was over, I drove home from the bus stop of Suwon Theater and disappeared on the way. Later, the body was found in the grass near Batam-myeon in Hwaseong County. During the autopsy, the forensic doctor took out 9 pieces of peaches and the victim's socks from the lower body.
During the investigation, intercity bus drivers Jiang (43) and Ba Jie Yan (22) who were driving to Hwaseong and Suwon at the time stated that there was one person aged 24-27 years old about 400 meters from the scene of the incident on the day of the incident. , A suspicious man with a height of 165-170cm took the bus.
This description quickly reminded the criminal police of a case involving the same criminal tactics during the second and third cases, but it was not included in the "Hwaseong serial homicide case."
On the last day of November 1986, when Jin went to the church alone at night, when he was about 300 meters away from home, his neck was suddenly locked from behind, and a murder weapon was used to hold her under her ribs and drag her off the main road. In the rice field, she walked about 200 meters deep into the field with her hold, until she could not see the lights of the village, she threatened her to take off her socks, tied her hands behind her back, tucked her panties in her mouth, covered her belly belt on her head, and implemented it. Sexual assault.
Then the murderer threatened her to surrender her belongings. Jin said that the handbag was left when he was kidnapped just now. After cursing and warning, the angry murderer turned back and searched the same way, while Jin took advantage of the gap and fled in the direction of the village. Finally, the villagers who heard the call for help rescued her.
Because Jin did not report the incident, the police knew that a long time had passed since the incident, so they could not find any physical evidence, leaving only some of the physical characteristics of the murderer described by Jin, "Hair is very short, face is very long, About 160~170cm, the voice is low, like 20s."
①In the later period of the case, the police had no progress in the investigation, so they could only start to expand the scope of the search. When they visited a certain village, they discovered that there were rumors of a woman being raped.
By comparing the descriptions of the three, the suspects were found to be highly consistent in their characteristics. The police immediately issued a reward warrant and conducted a comprehensive forensic investigation of surrounding men aged 20-30. Soon they collected more than 50,000 photos of nearby residents. Due to the shortage of case-handling personnel and the huge pressure caused by the supervision of the upper-level supervision and the guidance of public opinion, the investigation team had to take Jiang and Yan to conduct comparison work in the hotel room around the clock. While at work, a criminal police officer had a brain congestion due to overwork, and he still has hemiplegia.
② Jiang, Yan, Jin
Here is a rough analysis of the 5 million won reward. What was the concept at the time? Because of the overall economic growth of South Korea in the mid to late 1980s, the analysis results may be partly different from the actual conditions at the time. It is not guaranteed to be completely correct.
According to the 1980 South Korean civil servant salary table, it can be seen that the salaries of the 9th grade and 5th grade and 8th grade and 7th grade are 87,500 won and 104,000 won, respectively. 5 million won is equivalent to the salary of a junior civil servant in 4-5 years. In 1980, the average annual salary of professional baseball players was 12.15 million won, the price of an apartment in Seoul was 12 million won, barbecue was 3,500 won, a bowl of jjajang noodles was about 500 won, a bottle of shochu or kimchi was 200 won, and ramen was 100. won. Therefore, the 5 million reward was still quite attractive to the people at that time.
(For those who do not understand the level of Korean civil servants, please refer to the "Standards for Obtaining and Allocation Areas of Korean Government Offices", which shows that all employees below level 6 are grassroots affairs personnel.)
On the eve of the opening of the 1988 Seoul Olympics, 13-year-old Park Sang-hee was lying in his bed and never got up again. When her mother called her to get up the next morning, she found only a cold body.
The method used in this case is somewhat different, neither binding nor inserting foreign bodies in the oral cavity or body cavity. Remaining pubic hair and fuzzy footprints resembling wavy shading were found during the site investigation. In pubic hair, more than 300 times more than the standard titanium residue is detected. Such a high content of residue often appears on people who do welding or painting work.
This major discovery made the entire search department alive, and everyone felt that the prisoner could be caught immediately. The criminal police used this as a breakthrough, registering employees from 32 factories in Hwaseong to collect hair one by one. However, at work, we often encounter conflicts caused by extraction of pubic hair. At that time, because of the large number of people in the survey, the methods of statistics and comparison could not keep up. As the investigation cycle became longer, some criminal police appeared to move, and new criminal police joined the investigation. Later, because of the incomplete transfer of the procedures or the loss of the physical evidence, people who had collected the collection were called in again, and some even resorted to violent means.
The whole process was long and chaotic, and the morale of the police gradually became sluggish. After collecting more than 1,500 male hairs, a major discovery was finally made. Yin Yingze (22 years old) working in the agricultural machinery repair center was locked as a suspect and he was interrogated. He insisted that he was not guilty, but finally succumbed. Yin Yingze was sentenced to life imprisonment in July 1989, one year after the crime was committed. Later, due to his good performance during his sentence, he was commuted and was released in 2009.
On October 4, 2019, Li Chuncai claimed that the case was also his own, and the police are now verifying its authenticity. It is not excluded that Li Chuncai chose to induce the police to close the case in order to prevent more evidence from being discovered.
In July 1989, Jung Insook, a second-year high school girl who lived in Omokcheon-dong, Suwon City, disappeared on her way home after studying at school until she was discovered by a farmer Kyo (69 years old) in her own field a week later. He was working in the field. When there was a strong stench, the corrupted female student's body was found along the source, and this place was only 3 kilometers away from the place where the fifth victim Li Guishu was committed.
The detectives held their noses to investigate the scene. The corpse was completely naked, the front chest and back were punctured by a sharp tool, and one side of the chest was plucked off, but it was not tied up, which was slightly different from the "Hwaseong serial murder case". Although the police did not include this in the "Hwaseong serial homicide case", the location of the incident near Hwaseong and the vigorous reports of the newspapers caused the surrounding residents to panic even more.
Not long after the murder of a female high school student in Omokcheon-dong, Kim, a primary school student living in Bakery No. 5, disappeared on his way home from school at noon. In December of the same year, he found the skirt and schoolbag that Kim was wearing when he disappeared. After investigating his father twice, the police treated this as a mere case of loss. Li Chun did not publicly admit the case until October 2, 2019. After more than 30 years, he re-entered the link of investigation. But today Still unable to find Jin's body.
In September 1989, Li Chuncai broke into a house in Quanshan District, Suwon City. After being arrested, he argued that he was chased and panicked before breaking into the house. However, the police did not listen to him and sentenced him to one year and six months in prison at the Suwon District Court on February 7, 1990. Later, Li Chuncai appealed against the verdict. In the second trial on April 19, the court first found Li Chuncai guilty. However, considering that the victim suffered minor damages, he was sentenced to one year and six months imprisonment with a suspended sentence of two years. After being released, Li Chuncai did not cherish his hard-won freedom, and his lack of reverence for justice made him even more unscrupulous in his crimes. After analysis, Li Chuncai's intrusion should be for robbery and murder but the crime was stopped. Therefore, the police failed to link him to the Hwaseong serial homicide.
The victim of the ninth case was Kim Mi-jeong, a female student living in Taean-eup, Hwaseong County. On the day of the incident, someone at Kim Mi-jeong’s family was celebrating her birthday. She was ready but she did not return. The next day, Kim Mi-jeong was found on the mountain behind the Samsung Stone Factory. The half-naked body was lying quietly under a pine tree, wearing white panties and upper body cover. Wearing school uniform. A large number of hairs were collected at the scene, semen was found in the tops and socks, the corpse's chest was cut 38 times, chopsticks, forks, ballpoint pens and other artifacts were found in the lower body, and identifiable fingerprints were collected in the lunch box.
Soon after the incident, the police arrested a suspect Yin Moujun. After a series of interrogations and investigations, Yin Moujun was immediately released because of the DNA test discrepancy. He died of liver cancer a few years later.
On January 27, 1991, a police officer on patrol found a female body in the sewage pipe. The deceased was Miss Park, a worker in a nearby spinning mill. Miss Park, who returned home on the evening of the 26th, was kidnapped by criminals and dragged to an open space 100 meters away when she was passing by the construction site, where she was raped and murdered.
The last victim of the "Hwaseong Serial Murders" Human Rights Shunxiang, spent a pleasant day at the eldest daughter's house on April 3, 1991. After dinner, he took the bus home from Suwon and got off the bus. He was killed the next day. A passing truck driver Park (30) found the body while urinating in the woods.
Quan Soon Shin was killed in a pine forest less than 200 meters away from his home. According to the autopsy result, his lower body was stuffed with socks (same as An Jishun's experience in the eighth case). result.
Since the death of Kwon Soon, there has been no news of the culprit in the past 30 years. Until recently, this case had the opportunity to return to the public eye. Before that, everyone thought that the "Hwaseong serial homicide" was a crazy murderer. Stop here...
On June 24, 1991, Kim, a housewife in Cheongju, was strangled to death by a telephone line at home. According to an eyewitness, a young man in his 20s left at the scene of the crime. However, the investigation has not gone smoothly. After that, it was deadlocked. It was not until Li Chun admitted the case that the eyes were regained. Now the police are verifying the facts of the case that Li Chuncai confessed.
On the afternoon of January 13, 1994, Li Chuncai called her sister-in-law to get her toaster and prepared a drink containing sleeping pills. After meeting, she tricked her into drinking it and then raped it. In order to prevent the crime from leaking out, Li Chuncai hit her on the head with a blunt weapon to kill her, and transported the body to a hardware store 1km away in the middle of the night and abandoned it. After the murder, Li Chuncai went to visit his father-in-law and asked him if he could help or go to the police station with him to report his disappearance.
Two days later, the body was found by the wife of the owner of the hardware store. The police visited the family of the deceased for investigation and found that Li Chuncai had many suspicious points. He was always good at sophistry, and he was still performing happily in the face of interrogation, thinking that he could still escape the sanctions, but the neighbor next door provided decisive testimony. On the second day of the incident, I heard the sound of water in the bathroom of Li Chuncai's house at six o'clock in the morning, and a lot of clothes were dried. The police inspected the restroom of Li Chuncai's house, and successfully found the remaining blood stains on the base of the washing machine, and obtained the victim's DNA.
Under the iron evidence, Li Chuncai continued to sophistry, trying to escape the sanctions of the law, but ultimately failed. The court sentenced Li Chuncai to death in the first instance on the grounds that "these crimes were deliberately planned and there was no remorse." Li Chuncai immediately filed an appeal, but the appeal court did not change the sentence after verification. However, the death penalty decision was rejected by the Supreme Court on the grounds that "there was no detailed evidence to prove that the attack was planned."
In the same year, the criminal Li Chun was sentenced to life imprisonment. Although he was punished in this case, it is a pity that no one connected him to the Hwaseong serial homicide case at the time, which enabled him to escape successfully after 2006. Criminal sanctions for more than a dozen murders.
To this day, the place where the incident occurred is no longer what it used to be. With the tremendous growth of South Korea's overall economy in the past 30 years, the value of land has changed indefinitely. The Li Chuncai family has also benefited from repeated acquisitions of farmland and hoarding a large amount of land. According to South Korean media reports, it is now sitting on a fortune of tens of billions of won. Li Chuncai himself also actively performed in prison in order to be released as soon as possible, but now it seems that due to the outbreak of the "Hwaseong serial homicide", the desire for parole may be shattered.
postscript
In fact, such serial homicides were not a few cases at the time, but most of the cases were not exposed to the public eye. In the same period, there were also serial killings in Gongju City, South Chungcheong Province. The murderer Kang Chang-gu killed 6 women from 1983 to 1987. Fortunately, no more people were arrested and killed.
Today, the South Korean government is also making various efforts to reform. In the early years, the Korean law had a 15-year statute of limitations for homicide cases. After revising the Criminal Procedure Law in 2007, the time limit was increased to 25 years. , And apply to all homicides that occurred after 2000. In addition, due to the continuous fermentation of the "Taewan case" that occurred in Daegu, South Korea in 1999, the Korean National Assembly on July 24, 2015 abolished the 25-year statute of limitations for homicide prosecution with the "Criminal Procedure Law Amendment", which means that from now on, South Korea No longer tolerant of vicious crimes, criminals will bear the due price for their crimes for life.
However, along the long road to amendments to the bill, according to the statistics of the Korean National Police Agency, there are tens of thousands of cases every year, and the police have to stop investigating and destroying cases because the statute of limitations is exceeded. It also allowed these "invisible" criminals to escape legal sanctions smoothly. The original legislation for the limitation of prosecution was to treat the physical and psychological impact of criminals when they were wanted and arrested as a kind of punishment in disguised form. After the time limit is exceeded, the punishment for their criminal acts is deemed to have been completed, and no further investigation will be carried out in the law.
Such humanitarian-based legislation has become a death-free gold medal for criminals. How many people have been victimized as a result, and how many people are at large. Criminals who escape punishment by chance can really rehabilitate from the bottom of their hearts? Put down the butcher knife?
Compared with the twists and turns of South Korea's "Criminal Procedure Law," China's criminal law is much more cautious and strict in terms of statute of limitations. According to Chapter 4, Section 8: Limitation of the "Criminal Law of the People's Republic of China" revised in 1997, there are the following three articles on the legal provisions on the limitation of prosecution:
Article 87: The crime shall not be prosecuted after the following time limit:
(1) If the statutory maximum penalty is less than five years of imprisonment, five years have passed;
(2) Where the statutory maximum sentence is more than five years but less than ten years imprisonment, ten years have passed;
(3) If the statutory maximum sentence is more than ten years imprisonment, fifteen years have passed;
(4) If the legal maximum sentence is life imprisonment or death sentence, twenty years have passed. If it is deemed necessary to prosecute after 20 years, it must be reported to the Supreme People’s Procuratorate for approval.
Article 88: After the people’s procuratorate, public security organs, or national security organs have filed a case for investigation or the people’s court has accepted the case, those who evade investigation or trial shall not be subject to the time limit for prosecution.
If the victim files a complaint within the time limit for prosecution, and the people's court, people's procuratorate, or public security organ should open the case without filing the case, the time limit for prosecution is not restricted .
Article 89: The time limit for prosecution shall be calculated from the date of the crime ; if the criminal act is continuous or continuous, it shall be calculated from the date of the end of the criminal act .
If the crime is committed again within the time limit for prosecution, the time limit for prosecution of the previous crime shall be counted from the date of the subsequent crime.
The murderer Gao Chengyong of the "Serial Murder in Silver City" that China broke in 2016 was executed according to law on January 3 this year. The investigation, breaking, judgment, and execution of this case are the best proof of the statute of limitations for the motherland. The legal net is full of sparseness and without leakage. Today, China has already walked out of its backward history. It is not only reflected in its economic rise, but also comes from the people’s sense of security. This sense of security comes not only from grassroots police officers, but also from technological means. .
For many years, I finally had the opportunity to release this group photo. At that time, I felt that the case was unsolved and the complete family portrait was a bit of a violation. Now, although the criminal has not been punished, he may never be punished by law, but the story is not explained. The ending, the regret of not being able to capture, and the emotion of indignation are now accounted for. I also hope that under the framework of the law, I can maximize judicial justice to the survivors, and use the late justice to comfort the dead souls and soothe the hearts of the survivors.
(In the photo, the portrait next to the South Korean flag is the 11th President of South Korea-Jeon Doo Hwan)
