The girl is the only one who truly loves the choked child. She took the figurine from the boy's tombstone and planned to use her remaining life to accuse the parents of being desperate. Therefore, at the murder scene, she did not struggle or resist!
This is her plan, deliberately angering the child's father, and then murdering the child, so that the child's father's crime can really be confirmed. She can't sue for death, but she can create a murder to avenge the child.
