Factual justice and procedural justice

This film is very professional in dealing with the special conditions of the aircraft. However, the main purpose of this film is to show the conflict between procedural justice and factual justice. Although the captain used the so-called "instinct" flight driving skills to deal with the special conditions of the aircraft that could not be referenced in the flight manual, the result was not all survivors, but it was not easy. From the perspective of factual justice, no matter how bad the captain is in other aspects, it is never an exaggeration to define him as a "hero" through such a result. However, procedural justice is often a way to ensure that factual justice is not bad. It is the government's responsibility and obligation to supervise the operation of the aviation industry. Both NTSB and FAA are the institutions that put this into practice. The basis for the operation of these institutions naturally relies on industry regulations under the US legal framework. Alcoholism, drug use, and taking drugs that affect the nerves are behaviors that are considered to affect the normal operation of pilots. Therefore, NTSB conducts accident investigation, which is an indispensable standard checklist procedure. Although the fact that the captain saved people shows the brilliance of humanity, the violation of aviation regulations is the first thing that should be punished. In the end, the captain was sentenced to five years in prison, which should be attributed to violations of alcohol and drug abuse, resulting in partial criminal responsibility for the air crash. Why is there no life imprisonment. Therefore, the final judgment result should be a comprehensive consideration of procedural justice and factual justice. The spirit of the law should be a combination of procedural justice and factual justice, not a unity of opposites.
The accident prototype of this film is the National Geographic documentary "Air Catastrophe-Alaska Airlines Flight 261 Crash". If you are interested, please refer to the link below.

Flight quotes

  • Hugh Lang: I'm trying to save your life!

    Whip: What life?

  • Hugh Lang: [to Whip] The FAA and the NTSB took 10 pilots, placed them in simulators, recreated the events that led to this plane falling out of the sky. Do you know how many of them were able to safely land the planes? Not one. Every pilot crashed the aircraft, killed everybody on board. You were the only one who could do it!
